Courses Online Dental Ethics, herein also known as CODE, is

Agreement below, CODE or any portion thereof, including the Practice Ethics Assessment and Development program (PEAD, see below), may not be copied without the express written permission of the American College of
Dentists.
If you use CODE or any portion thereof to include viewing, reading, operating,
course and test taking (or taking assessment activities in the case of PEAD), and evaluating, then you agree that you
understand and accept the following disclosures, statements, terms, and conditions as an express
Agreement between you or your organization and
the developer, American College of Dentists, and any other distributors of
CODE. If you do
not accept this Agreement, then you may not use CODE.
Purpose. The purpose of CODE is to heighten ethical and professional
responsibility, promote ethical conduct and professionalism in dentistry, advance dialogue
on ethical issues, and stimulate reflection on common ethical problems
in dental practice.
Permission. You have permission to
use CODE for personal or non-profit educational use only, provided you
expressly agree to:
- not alter CODE;
- not sell or trade CODE; and
- only use CODE in a manner consistent with the mission,
principles, objectives, ideals, and reputation of the American College of
Dentists.
Sections of CODE, including PEAD and the ethical dilemmas published in the Texas Dental Journal between 1993 and 2005 and compiled digitally in 2008 by the American College of Dentists (see below), may
be printed and/or copied for personal or non-profit educational use only subject to the terms and conditions of this Agreement. All other contemplated uses
of CODE, to include copying and electronic duplication, require the express written permission of the American
College of Dentists.
By using all or part of CODE in an approved application, the
user agrees to appropriately credit the American College of Dentists
as the developer of CODE and include the Internet
address for CODE as www.dentalethics.org.
Ethical Dilemmas. Ethical dilemmas published in the Texas Dental Journal between 1993 and 2005 were compiled digitally in 2008 by the American College of Dentists; the dilemmas are used with the permission of the Texas Dental Journal. These dilemmas are available in PDF file format by download from the Internet or on compact disc (CD). These digital ethical dilemmas are part of CODE. The terms and conditions that apply to CODE also apply to these ethical dilemmas. If you do
not accept this Agreement, then you may not use the digital ethical dilemmas.
Practice Ethics Assessment and Development (PEAD). PEAD is a comprehensive, voluntary, program for practicing dentists to self-assess the ethical climate and foundation of their practices through guided self-evaluation exercises and activities. The PEAD program is part of CODE. The terms and conditions that apply to CODE also apply to PEAD. If you do
not accept this Agreement, then you may not use PEAD.
Possible Defects. CODE or any portion thereof may contain defects that include,
but are not limited to:
- incomplete, inaccurate, incompatible, insecure, or corrupt content;
- transcription and/or programming errors;
- intellectual property infringement;
- content that damages your hardware and/or software; or
- infection by one or more computer viruses.
The possible defects are mentioned in the interests of disclosure, and
such inclusion should not be interpreted to mean that CODE is offered with
known defects. If defects are uncovered, please contact the developer so
that the defects may be addressed.
Security.
Registration information is necessary for the operation and administration
of CODE by the American College of Dentists. Information generated by
specific users in the course of using CODE, including PEAD,
(e.g., through registration, course and test taking, evaluations) is considered confidential and
will not be sold or otherwise be made available to individuals or
organizations outside of the American College of Dentists or the American
College of Dentists Foundation without the permission of the user.
Although CODE is considered a secure site and incorporates Secure Sockets Layer (SSL) encryption protocol, the security of user-generated information is not guaranteed. There is a risk, believed to be small, that such information will be misdirected (e.g., through e-mail),
lost, stolen,
or co-opted
for unauthorized access or use. If you are at all concerned about
this risk, please do not to register. General compilations of data from
CODE, including PEAD, that do not identify specific users may be collected, shared,
analyzed, and/or published to improve CODE and/or advance our knowledge and understanding of
ethics education and
related areas.
Indemnity. By using CODE, including PEAD, then you agree to indemnify and hold the
developer and its agents, officers, members, and distributors harmless against any and
all claims arising out of said use or distribution, regardless of the
cause, effects, or fault.
Limitation of Liability.
Neither the developer nor anyone else who has been involved in the
creation, production, distribution, or delivery of CODE, including PEAD, shall be liable
for any direct, indirect, consequential, or incidental damage
(including damage for loss of business profit, business
interruption, loss of data, and the like) arising out of the use of
or inability to use CODE even if the developer has been
advised of the possibility of such damage. Some jurisdictions may
not allow the exclusion or limitation of liability for consequential
or incidental damage.
Warranty Disclaimer. The developer of CODE, including PEAD, and any distributor disclaim all liability
to you for damages, costs, and expenses, including legal fees, for any
real or alleged defect in CODE. You have no remedies for negligence or
under strict liability, or for breach of warranty or contract, including,
but not limited to, indirect, consequential, punitive, or incidental
damages, even if you give notice of the possibility of such damages.
CODE, including PEAD, is provided to you "as is" and "as available." No
other representations or warranties of any kind, express or implied, are
made to you regarding CODE, including, but not limited to, fitness
for a particular purpose. No oral or written information or advice given
by the developer, its agents, officers, members, or distributors shall
create a warranty, and you may not rely upon such information or advice.
CODE—including the courses, ethical diliemmas, PEAD, and all other contents—is not intended to:
- provide legal advice;
- provide advice or assistance in the
diagnosis or treatment of dental diseases or conditions; or
- provide advice or assistance in the management of dental patients, practices, or personnel.
This Agreement shall be governed by the laws of the State of
Maryland. If for any reason a court of competent jurisdiction finds
any provision of this Agreement, or portion thereof, to be
unenforceable, that provision of the Agreement shall be enforced to
the maximum extent permissible so as to effect the intent of the
parties, and the remainder of this Agreement shall continue in full
force and effect. If any part of this Agreement is not legally binding, it shall in no
way affect the validity
of the other parts of the Agreement.
